We must end the Nanny State!

We recently saw the passage of a federal takeover of the health care and health insurance industries. Part of this action included a federal mandate that individuals purchase health insurance. This is both unconstitutional ( see my book "A Call for Action" ) and part of a pattern of our government passing nanny state laws, because politicians and bureaucrats want to decide what is best for the citizens of our country instead of allowing people the freedom to choose for themselves. My book is about Social Security, but the constitutional problems listed will all apply to Obamacare.

I ask that you consider an action which is needed to stop congressional busybodies from trying to micromanage our lives. I ask that you consider amending our Constitution.  Such an action will not be easy and should be the subject of a vigorous national debate.

The language of such an amendment could be as simple as the following:

Congress shall make no law requiring the purchase of any good or service, or make any law which has a primary purpose of protecting people from themselves.

The Constitution provides the procedures for amendment.

Article. V.

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

l have included the entire section to how the Constitution can be amended. The requirement for a two thirds vote in both houses and then for ratification by 75 percent of the states is a very steep hill to climb. We need to consider this action because the authoritarians in our midst are trying to destroy this country and the individual liberty that is supposed to be guaranteed by the Constitution.

If the courts rule Obamacare unconstitutional, The proposed amendment shown above would not be necessary. The problem with the courts is that history shows we can not rely on the court to protect us. There have been many occasions when the courts have ignored clear language in the Constitution. In the absence of a Supreme Court decision throwing out Obamacare, we need to move forward to amend the Constitution.

A less draconian option would be for Congress to use the powers in Article III, Section 2 discussed in the essay on Obamacare. You the voter must decide between electing people who will make needed changes or becoming a slave of the nanny state.

First, I will need your votes, and the votes of everyone you know. Neither of the actions listed above will occur unless you elect people to Congress who will act. You must vote against the two major parties and for individuals who will make a commitment to honor the oath of office. The oath is not a mere procedural requirement for assuming office. It is a solemn vow which must be accorded as much or more deference as a person's wedding vows. A spouse can be replaced, our Constitution can not.

To get this proposal considered by Congress, I need to get elected or at the very least, get enough votes to get the issue noticed.

The proposed amendment listed above addressed one major problem. The reality we face is that there are many problems which need to be addressed. A proposed amendment to the Constitution could cover several items. If the combined amendment does not get the needed support then we could propose individual amendments. I will still need your votes and support if you would like to see an amendment, stopping the types of abuses to our economy and way of life, that we have recently witnessed.
